Brian Kopp’s unofficial guidebook, “The Ultimate World of Warcraft Leveling & Gold Guide,” is back on sale. The author had his day in court, so to say, and won.
In a true underdog type battle, Kopp butted heads with some of the gaming industry’s biggest names and came out the winner. This is good news for a number of reasons, but not the least of which is the fact the little guy won. Also good here is the fact Vivendi and Blizzard were willing to back down. The companies settled Kopp’s suit by agreeing to withdraw their complaints against him and acknowledging the guide did not use copyrighted materials.

We praise the companies' decision to allow our client to continue selling his unofficial guide and to fully honor the provisions of the DMCA," said Greg Beck, the Public Citizen attorney representing Kopp. "We urge other companies to follow this example and avoid terminating the auctions of eBay sellers who have filed counter notices in defense of their goods. We are alert to the widespread abuses of the DMCA process, and companies that continue to abuse the process do so at their own risk."
Kopp’s book, which sold for $15 a copy over eBay, was pulled last year from the sales site when Blizzard, Vivendi and the ESA all filed complaints. Kopp filed counter-complaints and was able to begin selling the book again. But, in November, Kopp’s book was again taken off the site. The lawsuit followed early this year.
