Wii Lawsuit Without Merit - 22.12.06

Nintendo WiiNintendo officials have made a formal response to the class action lawsuit seeking damages against the company for its “unfair or deceptive practices.”

Nintendo says the suit is “completely without merit,” according to Games Industry.biz.

The suit itself claims the Wii’s wrist strap is ineffective and has breached the device’s warranty.

"Nintendo has a long tradition of delivering high-quality products and excellent customer service, and we take all reports from our customers seriously," said the company in a statement.

"At the time we became aware of the lawsuit, we had already taken appropriate steps to reinforce with consumers the proper use of the Wii Remote and had made stronger replacement wrist straps available. This suit has had no effect on those efforts," said the company.

Nintendo has some very strong points here.

Based on the handling of the Wii strap issue, it appears to me Nintendo has done everything possible to make what was wrong right. It has warned gamers of the problem. It created a thicker wrist strap, and it is also recalling the initial straps for replacement.

Short of trying to prove Nintendo intended for this to happen, which is more than doubtful considering the company’s response, the suit does seem to smack of a frivolous action designed to make some people fast money.
