Wii Strap Results In Lawsuit - 21.12.06

Wii Photo ChannelWhether Nintendo would get sued over its Wii strap or not hasn’t really been a question. What was up in the air is when it would happen.

The answer’s out.

San Fransciso-based Green-Welling LLP has filed a class action lawsuit against Nintendo in regard to its breaking Wii strap.

“The class action lawsuit arose as result of the defective nature of the Nintendo Wii,” states the firm’s Web site. “In particular, the Nintendo Wii game console includes a remote and a wrist strap for the remote. Owners of the Nintendo Wii reported that when they used the Nintendo remote and wrist strap, as instructed by the material that accompanied the Wii console, the wrist strap broke and caused the remote to leave the user’s hand. Nintendo’s failure to include a remote that is free from defects is in breach of Nintendo’s own product warranty.”

The lawsuit is open to claimants throughout the United States.

Considering how fast Nintendo responded to complaints about the straps with A.) more stringent warnings, and B.) replacement straps, I have to wonder how far this suit will go. It seems like the company did cover its bases when overzealous gamers started reporting issues, but now it’s ultimately up to a judge to decide whether there's a real claim here or people are chasing a cash cow.
